Barre Town Supervisory District Policy Manual

TITLE: Extended School Year     CODE: IHBA

  1. Each school district within the Barre Supervisory Union will provide for such services as required by law. It is recognized that it may be necessary in some instances to provide such services to such a student over an extended school year ("ESY") (that is, a period beyond the regular school year) in order to provide an appropriate special education program to the student.

  2. Such a student shall be provided extended school year special education and/or related services if the student has been determined by the Evaluation and Planning Team to be eligible for special education and related services in accordance with state and federal regulations within the last three years; and where the IEP team has determined:

    a. That specified extended school year services are an essential (not simply beneficial) component of the student's IEP, in that benefits accrued to the student during the regular school year would be significantly jeopardized if the student were not provided particular special education and/or related services during the summer months; or

    b. That a summer break without specified special education and/or related services is likely to cause the student to suffer severe regression and such loss of skills combined with limited recoupment ability, will significantly increase the likelihood of the student failing to achieve IEP goals or objectives.

  3. Procedures implementing this policy shall be promulgated and revised as necessary by the Superintendent of Schools or his/her designee. In implementing this policy, the school district shall not limit extended school year services to particular categories of disability; nor may it unilaterally limit the type, amount or duration of ESY services.

  4. Steps shall be taken by special education personnel to inform parents of students eligible for special education and related services of the existence of this policy and implementing procedures, and of their right to challenge decisions concerning ESY services through the due process hearing procedure.
